From my knowledge, this seems like one of the bigger pickles where Bush hath overstepped his boundaries: the muddled firings of the U.S. Attorneys. Can Bush tell Sara Taylor and Harriet Miers not to comply with the subpoenas sent out by Congress if they don't even work for him anymore? Shouldn't they still face repercussion? Fred Fielding said "there are many previous examples just like this" but he failed to mention any. Sen. Specter says that taking them to court for contempt won't do any good because the prosecutor that would be on the case is a Bush appointee. But since when does a former employee have this much privilege to not have to answer any questions from Congress as to what happened while they worked in the White House?

Can the Shrub really claim any kind of executive privilege for FORMER Justice Dept. employee subpoenas?
No. Once you are discharged, or your resignation is accepted, you are under no obligation to the White House and there can be no extension of executive privilege.. Where there is no duty, there is no damage. There is of course an exception for matters that may fall under national security...but that can still be reviewed.
Of COURSE they can testify. These are very funny times indeed.

Reply:It appears that bush is under the mistaken impression that "executive priviledge" means that the laws of the USA do not apply to him or anyone in his administration.
